Terms and Conditions

“The Supplier” means Murano Building Trust T/A Econofire and all of it’s subsidiary and associated companies

1. General

The laws of South Africa govern these terms and conditions. By accessing this website, you consent to these terms and conditions and to the exclusive jurisdiction of the South African courts in all disputes arising out of such access.

A comprehensive user manual is supplied with the product. The user manual contains vital information regarding the correct usage and assembly of the product. Any damage as a result of incorrect usage is not covered by the manufacturer’s warranty. It is thus the client’s responsibility to ensure that the product is used and maintained correctly.

2. Payment terms

Payment in full upon presentation of the relevant tax invoice.  Goods remain the property of the Supplier until paid in full.

3. Defects

We do our best to ensure that the products we deliver to you are of a high quality, and in good working order and without defects.

If you have received a product which turns out to be defective, please notify us as soon as reasonably possible after you become aware of the defect, but in any event within 7 days after delivery / collection of the product.

4. Returns and refunds

If for any reason you wish to return your product/s, you the customer may do so within 7 days of the products being collected by you or delivered to you, provided the product/s have not been used, are complete, in their original condition, and sealed in the original packaging.

For products that are not defective or not in original condition, handling charges will be applicable. A discretional handling/administration fee of 15% will be charged at managements discretion. This amount will be deducted from the refund / credit.

Notwithstanding the above, products that have been discounted, are sold voetstoots and may not be exchanged or returned.

5. Delivery

You have the right to refuse delivery of any product that is visibly damaged upon delivery. Please stipulate clearly that you have not received the goods with a brief description of the damage on the delivery note. The driver/delivery company will take the product/s back with them and return them. Please contact us immediately to report this.

The Customer acknowledges that a delivery date given in advance is an estimation of delivery date and while we will endeavour to ensure that delivery is completed as soon as is reasonably possible after the estimated delivery date, it shall not be liable for delays resulting from any cause beyond its control. Upon receipt of the Product/s the Customer will inspect the Product/s and must inform the Supplier of any errors by way of written notice within 7 (seven) days of receipt of the Product/s by the Customer. In the event that the Customer fails to notify the Supplier of any such claim within the specified time period, such failure shall constitute a waiver of any such claim.

6. Indemnity

The customer hereby undertakes to indemnify Econofire (“the Supplier’’) against any claims for harm /damage (including any loss or damage that may be incurred / sustained due to circumstances such as theft) that may result due to reasons beyond the reasonable control or unintentional act of any person, whether or not in the employ or in his/her representative capacity of the Supplier. This will include any economic loss pertaining to such harm/damage caused due to circumstances beyond the reasonable control of the Supplier.

7. Warranties

The supplier warrants to the Customer that this product shall be free from defects in workmanship and materials after correct assembly and under normal and reasonable use. Inception of warranty begins when the product is purchased (date of original invoice) and will be effective for one year.

Warranty does not cover dropping, chipping, cracking, surface corrosion, scratches or rust. The supplier reserves the right to request evidence of damaged or defective parts. This would include the return of the damaged/defective product or parts for review and examination.

Customers need to retain proof of payment as well as invoice for all returns or replacements. The Supplier will repair or replace the parts which are proven defective during the applicable warranty period. Defective or missing parts subject to this limited warranty will not be replaced without proof of purchase. Parts required to complete such repair or replacement shall be free of charge to you except for shipping costs, as long as the purchase is within the warranty period.

This limited warranty ONLY applies to the functionality of the product and does not cover cosmetic issues. It is the customers responsibility to ensure the product is assembled and installed correctly as per provided user guides and any deviation from this will void the limited warranty.

The limited warranty will not include:

  • faults and failures as a result of force majeure
  • seals of the door and glass
  • glass
  • loose components in direct contact with the fire
  • downdraught of flue gases
  • defects & faults arising from transportation
  • defects & faults arising from overloading and overfiring of the product
  • defects & faults arising from the use of incorrect or unsuitable fuel
  • defects & faults arising from incorrect installation, use, cleaning, maintenance or servicing
  • paint discolouration, corrosions, rust and powder paint chipping
  • faults and issues arising from repairs not by Econofire, including the result of non-original parts
  • Service fee call outs and labour charges to repair and/or replace any item under warranty
  • Repairs to defects or damages of the fireplace or installation due to customer negligence or misuse of the product
  • Damages due to accidents, alteration of the product, misuse, lack of maintenance, fire, floods or other natural disasters, improper installation or installations not in accordance with local authority by-laws and National Building Regulations.
  • Removing and reinstalling part of the fireplace
  • Shipping cost for warranty/non-warranty replacements parts

Warranty is not transferable from the original owner listed on the sales invoice

Unauthorised modifications and/or incorrect usage/installation will render this warranty null and void.

This limited warranty will not reimburse you for the cost of any inconvenience, personal injury or property damage. If an original replacement part is not available, a comparable replacement part will be sent. You will be responsible for all shipping charges of parts replaced under the terms of this limited warranty.

8. Disclaimer of limited warranty and limitation of remedies

The customers exclusive remedy under the terms of this limited warranty is to either repair or replace defective parts. The Customer will not hold the Supplier responsible for any consequential or incidental damages arising from the breach of either this limited warranty or any implied warranty. This indemnity will apply to failures or damage due to acts of God, improper care and maintenance, fire, accident, alteration, replacement of parts by anyone other than the original Supplier, misuse, transportation, improper installation or installations not in accordance with electrical or plumbing codes.

This limited warranty is the sole warranty given by the Supplier. No other warranty except to extent set forth in this document will be considered.

Neither dealers nor the retail establishment selling this product has any authority to make any additional warranties or to promise remedies in addition to or inconsistent with those stated above. The Suppliers maximum liability, in any event, shall not exceed the documented purchase price of the product paid by the original customer. This warranty only applies to units purchased from an authorised retailer.

9. Accounts and Security

You acknowledge that that no commerce solution, interactive service, website, app, database or system (including this Website) is completely secure and we cannot anticipate all potential misuse of systems or data. If you choose, or are provided with, a user name, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Website, or portions of it, using your user’s name, password or other security information.

10. Variation

We may revise these Terms at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere on the Site.

11. Intellectual property

The copyright in the material contained in this website and any brands included in that material belongs to Murano Building Trust and its subsidiaries.

You may download or copy the content and other downloadable items displayed on the website subject to the condition that the material may only be used for personal non-commercial purposes. 

12. Disclaimer

While The Supplier takes reasonable measures to ensure that the contents of this Website are accurate and complete, The Supplier makes no representations or warranties, whether express or implied, as to the quality, timeliness, operation, integrity, availability, or functionality of this Website or as to the accuracy, completeness or reliability of any information on this Website. The Supplier reserves the right to make changes, corrections, and/or improvements to the information and to the products and programs described in such information, at any time without notice.

The Supplier will use reasonable endeavours to maintain the availability of the Website, except during scheduled maintenance periods, and reserves the right to discontinue providing the Website or the service or any part thereof with or without notice to you.

Any person who accesses this Website or relies on this Website or on the information contained in this Website does so at his or her own risk.
